These Terms of Service (“Terms”) govern your access to and use of Gheelish.com and any related content, features, tools, products, accounts, subscriptions, and services collectively referred to as the “Services.”

The Services are operated by FYK Inc. d/b/a Gheelish (“Gheelish,” “we,” “us,” or “our”). Our online store is powered by Shopify.

By accessing the Services or purchasing from us, you agree to these Terms and all policies referenced in them. If you do not agree, do not use the Services.

Eligibility

You must be at least the age of majority in your jurisdiction or have permission from a parent or legal guardian to use the Services.

You may not use the Services or our products for an unlawful or unauthorized purpose.

Online Store

We may refuse, limit, or cancel an order where reasonably necessary, including suspected fraud, unauthorized resale, pricing errors, inventory problems, shipping restrictions, or violation of these Terms.

We may limit quantities purchased by a person, household, account, payment method, billing address, or shipping address.

If we change or cancel an order, we may attempt to notify you using the contact information provided during checkout.

Product Information

We make reasonable efforts to present product descriptions, ingredients, photographs, pricing, availability, and other information accurately. However:

• Packaging and appearance may change

• Screen displays may not reproduce colors accurately

• Product information may contain errors

• Products may be changed or discontinued

• Availability is not guaranteed

The information printed on the physical product packaging controls if it differs from information displayed online.

Food, Ingredients, and Allergens

You are responsible for reviewing ingredients, allergen statements, nutrition information, preparation instructions, and other package disclosures before consuming a product.

Ghee is made from butter. Although the clarification process removes most milk solids, individuals with a severe milk allergy should consult an appropriate medical professional before consuming products containing ghee.

Information on our website is provided for general informational purposes and is not medical, nutritional, or healthcare advice. Statements about products have not necessarily been evaluated by the Food and Drug Administration and are not intended to diagnose, treat, cure, or prevent disease.

Do not consume a product if its seal is broken, packaging appears compromised, the product shows signs of contamination, or the product is subject to a recall.

Prices and Payment

Prices, promotions, shipping offers, discounts, and product availability may change without notice.

You agree to provide accurate, current, and complete billing and account information. You authorize us and our payment providers to charge the payment method supplied for your order, including applicable taxes, shipping charges, and recurring subscription charges.

We may correct pricing or product-information errors and cancel affected orders. If an order is canceled after payment, the applicable amount will be refunded.

Subscriptions

Certain products may be offered on a recurring subscription basis. Subscriptions automatically renew until canceled.

By purchasing a subscription, you authorize recurring charges at the frequency and price disclosed during checkout, subject to applicable taxes, shipping charges, and permitted price changes.

Subscriptions are also governed by our Subscription Policy. You may cancel through the available subscription-management portal or by contacting hello@gheelish.com before the applicable processing deadline.

Shipping

Orders are subject to our Shipping Policy. Shipping and delivery dates are estimates and are not guaranteed.

You are responsible for providing a correct and deliverable address. We are not responsible for delays or additional costs caused by incorrect addresses, carrier interruptions, weather, theft after delivery, or events outside our reasonable control, except as required by law.

Returns, Replacements, and Refunds

Food sales are generally final because returned food cannot be resold. Refunds and replacements are governed by our Return and Refund Policy and Damaged Food & Quality Policy.

Nothing in these policies limits rights that cannot legally be waived.

Accounts

You are responsible for maintaining the confidentiality of account credentials and for activity conducted through your account.

Notify us promptly if you believe your account has been accessed without authorization. We may suspend or terminate an account to protect customers, Gheelish, or the Services.

Intellectual Property

The Services and their contents—including the Gheelish name, logos, trademarks, packaging, photographs, illustrations, text, graphics, videos, software, and designs—are owned by or licensed to FYK Inc. and are protected by intellectual-property laws.

You may use the Services for personal, noncommercial purposes. You may not reproduce, modify, distribute, sell, exploit, scrape, republish, or create derivative works from the Services without our written permission, except as permitted by law.

Reviews, Feedback, and Submissions

If you submit a review, photograph, comment, suggestion, idea, or other content, you grant us a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display that content for lawful business purposes.

You represent that you have the necessary rights to submit the content and that it does not violate another person’s rights or applicable law.

We may remove content that is fraudulent, misleading, unlawful, abusive, infringing, or otherwise inappropriate.

Prohibited Conduct

You may not:

• Violate applicable laws

• Infringe intellectual-property or privacy rights

• Submit false, fraudulent, threatening, or harmful content

• Introduce viruses, malware, or destructive code

• Interfere with the security or operation of the Services

• Scrape, crawl, or extract information without authorization

• Attempt to gain unauthorized access to accounts or systems

• Use the Services to send spam

• Purchase products for unauthorized resale

• Circumvent purchase, promotional, or geographic restrictions

Third-Party Services and Links

The Services may contain tools, integrations, content, or links provided by third parties, including Shopify, payment providers, retailers, shipping carriers, social networks, and subscription providers.

Third-party services are governed by their own terms and policies. We do not control and are not responsible for third-party websites, products, practices, security, availability, or content.

Privacy

Our collection and use of personal information are described in our Privacy Policy. Shopify may separately process personal information as described in the Shopify Consumer Privacy Policy.

Service Availability

We may modify, suspend, restrict, or discontinue all or part of the Services at any time. We do not guarantee that the Services will always be uninterrupted, timely, secure, or error-free.

Disclaimer of Warranties

To the fullest extent permitted by law, the Services and products are provided “as is” and “as available,” except for warranties expressly stated by us or that cannot legally be excluded.

We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement to the extent permitted by law.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, FYK Inc., Gheelish, and their respective officers, directors, employees, affiliates, agents, contractors, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or related to the Services or products.

Where liability cannot be excluded, our liability will be limited to the maximum extent permitted by law.

Nothing in these Terms excludes liability that cannot legally be limited or excluded.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless FYK Inc., Gheelish, and their officers, directors, employees, affiliates, agents, contractors, and service providers from third-party claims arising from your violation of these Terms, applicable law, or another person’s rights.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain effective. The unenforceable provision will be limited or modified only to the extent necessary to make it enforceable.

Termination

We may suspend or terminate access to the Services if you violate these Terms or use the Services in a way that creates legal, security, or operational risk.

Provisions that by their nature should survive termination will remain in effect.

Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on this page with an updated revision date.

Your continued use of the Services after an update constitutes acceptance of the revised Terms to the extent permitted by law.

Entire Agreement

These Terms and the policies referenced in them constitute the agreement between you and FYK Inc. concerning the Services and supersede prior communications concerning the same subject matter.
